2. Scope of These Terms

These Terms apply to:

• Visitors to our public website
• Registered users of the noink platform (including, but not limited to clinicians, patients, researchers, administrators)
• Organisations or individuals evaluating or piloting our services

If you are entering these Terms on behalf of an organisation, you confirm that you have the authority to bind that organisation.

3. Use of the Platform

By using the Platform, you agree that:

• You are at least 18 years old or have consent from a guardian if using as a minor (in supported jurisdictions)
• You will use the Platform only for lawful, ethical, and permitted purposes
• You will not upload, distribute, or transmit any material that is unlawful, harmful, or infringing
• You are responsible for keeping your login credentials secure and confidential

We reserve the right to suspend or terminate your access if you breach these Terms or misuse the Platform.

4. Platform Functionality

Our platform enables:

• Secure, structured health data capture (e.g. symptoms, medications, observations)
• Configurable forms, trial modules, and workflow logic
• Patient-reported outcomes, eConsent, and eSource tools
• Multilingual data entry and review
• Multi-condition and multi-user logging

We do not provide clinical diagnosis or medical decision-making. Any health information logged via the platform should be interpreted in conjunction with qualified healthcare providers.

5. Clinical Use Disclaimer

The noink platform is intended as a digital tool to support data collection and health engagement. It is not a medical device, does not replace professional medical advice, and should not be used for emergency decision-making.

6. Intellectual Property

All content, design, code, data models, trademarks, and software associated with noink is the intellectual property of DSST Limited or its licensors. You may not reproduce, distribute, reverse-engineer, or create derivative works without prior written permission, except as expressly permitted under license.

7. Privacy & Data Handling

Use of the platform is subject to our Privacy policy and Data Security & Compliance policy, which includes:

• What personal and health-related data we collect
• How we store and protect your data
• User rights under GDPR and other relevant laws

If you are a data controller (e.g. a CRO or healthcare organisation), you are responsible for obtaining valid patient consent and complying with applicable data protection laws.

8. Data Hosting and Security

We use encrypted, regionally compliant hosting services to store data (e.g. UK, EU, US). We maintain:

• Access control and user role permissions (RBAC)
• Full audit trails
• Secure data backups
• Protocols for data breach response and reporting

11. Licensing and Access

Access to noink may be:

• For individual/personal use

You must not sublicense, resell, or share access outside your authorised users or organisation.

12. Limitation of Liability

To the fullest extent permitted by law:

• We will not be liable for any indirect or consequential damages, loss of data, revenue, or business interruption
• Total liability (if any) shall not exceed the fees paid to us in the preceding 12 months

13. Termination

We may suspend or terminate access to the platform if:

• You breach these Terms
• Your subscription expires or is not renewed
• We discontinue the service (with prior notice)

You may stop using the platform at any time. Upon termination, your access will be disabled, and data retention will follow applicable policy or contract.

15. Governing Law & Jurisdiction
